Terms of Service

Build Phaze is provided by Farmyard Labs Ltd, a company registered in England and Wales (company no. 17507812), whose registered office is at 124-128 City Road, London, England, EC1V 2NX. These terms are the agreement between you and Farmyard Labs Ltd ("we", "us") for using Build Phaze. By creating an account, you agree to them. If anything is unclear, email support@buildphaze.app before you subscribe.

The service

Build Phaze is a renovation-planning app. We give you a personal licence to use it on your own devices to plan your own renovation projects. Don't sell, share, copy or reverse-engineer the app, or try to break it. The app, its design, text and task catalogue belong to us or our licensors. What you enter belongs to you. You must be 18 or over.

Important: no professional advice

Build Phaze is a planning tool. It is not architectural, structural, electrical, plumbing, engineering, legal, financial or any other professional advice, and nothing in it has been checked, approved or certified by us. That includes task suggestions, warnings, budget figures, build orders and the summary documents it creates. Renovation work carries real risks, including injury and damage to property. Before you act, check your plans with a qualified professional and make sure they meet the building regulations, permissions and other rules that apply to you. The work and your decisions are yours.

Summary documents (for your own records, or to share with a lender, broker or insurer) are made automatically from what you entered, and we haven't checked them. Read them before you rely on them or share them.

This section is a warning about how to use Build Phaze safely. It does not reduce our responsibility under "Our responsibility" below.

Subscriptions

A subscription is needed to use Build Phaze. It is sold through the App Store or Google Play, which show the price, the billing period and any introductory offer before you subscribe.

• Apple or Google takes the payment at the price shown. We never see your card details.
• It renews automatically until you cancel. Cancel before the current period ends to stop the next payment (Apple needs at least 24 hours' notice). You keep access until the end of the period you have paid for.
• Manage, cancel or switch between the monthly and annual plans in your App Store or Google Play subscription settings (Account > Manage subscription in the app takes you there).
• If the price goes up, we will tell you in advance in line with the store's rules, and the new price won't apply to you until you have had the chance to cancel.
• Deleting your account does not cancel your subscription. Cancel it in your store settings first.

Cancelling and refunds

If you are a consumer, you normally have 14 days from subscribing to cancel without giving a reason. Build Phaze is digital content you can use as soon as you subscribe, so when you subscribe you ask us to start straight away, and once access has started you lose the 14-day right, as the law allows. You can still stop your subscription renewing at any time.

Apple or Google handles payments and refunds under their own policies, so we can't refund you directly. This does not affect any right to a refund, repair, replacement or price reduction that you have by law.

Your account and your data

• Give us accurate details and keep your login secure.
• Delete your account any time from Account > Delete account in the app, or at buildphaze.app/delete-account. This permanently removes your account, your feedback and support requests, and our records of the terms you accepted. If you delete in the app, your renovation plan is also removed from that device. Deleting from the website can't reach your device, so a plan there stays until you delete the app.
• Your renovation plan (projects, tasks, photos, documents and contacts) lives on your device, and is kept separately for each account signed in on that device. We don't receive it and can't recover it if you lose or reset your device or delete the app. If your device's own backup is switched on (for example Google's backup on Android or iCloud backup on iPhone), it can include the app's data; that backup belongs to you, not to us. Use Account > Export backup to keep your own copy.

Using Build Phaze fairly

Don't use Build Phaze for anything unlawful, or to disrupt the service. If you seriously or repeatedly break these terms, we may suspend or end your access, and where it is reasonable we will tell you why first. If we ever stop providing Build Phaze, we will give you at least 30 days' notice and explain how to get a refund for any period you have paid for but can't use.

Our responsibility

• We will provide Build Phaze with reasonable care and skill.
• Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else the law does not allow us to limit or exclude.
• If you are a consumer, the law says digital content must be as described, of satisfactory quality and fit for purpose. If it isn't, you may be entitled to a repair or replacement, a price reduction, and compensation (including if it damages your device or other digital content). Nothing in these terms takes those rights away. Citizens Advice can explain them.
• If we break these terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss is foreseeable if it was an obvious consequence of what we did or failed to do, or if you and we both knew it was possible when you subscribed.
• If you use Build Phaze for business (for example as a landlord or builder), we are not responsible for business losses such as lost profit, lost business or business interruption.
• We are not responsible for a failure caused by something outside our reasonable control, such as a store, network or device outage.

Changes

We may change or remove features for valid reasons: to fix problems or keep Build Phaze secure, to follow the law or the app stores' rules, to improve it, or because something we rely on is no longer available. If a change materially disadvantages you, we will tell you in advance and you can cancel before it takes effect.

We may change these terms for the same reasons. We will give you at least 30 days' notice in the app or by email, unless a legal or security reason means it has to be sooner. If you don't agree, you can cancel before the change takes effect; if you keep using Build Phaze after it takes effect, you accept the new terms.

Other points

• Apple and Google are not parties to these terms and are not responsible for Build Phaze or its support. Your purchase is also subject to the terms of the store you bought it from.
• These terms are governed by the law of England and Wales. If you are a consumer living in Scotland or Northern Ireland, you can bring a claim in the courts there, and the consumer protections of your home country still apply to you. Otherwise the courts of England and Wales have jurisdiction (exclusive jurisdiction if you use Build Phaze for business).
• How we use your information is explained in our Privacy Policy.
